Conditions of Participation
Participation in the competition of Delicatino GmbH, Neidenburger Straße 9, 28207 Bremen, Germany, hereinafter referred to as the "Organiser", is free of charge and is governed exclusively by these conditions of participation.
Eligible participants
The competition is open to natural persons residing in Europe who have reached the age of 18. The participation is not limited to customers of the organizer and does not depend on the purchase of goods or services.
Employees of the organizer and its affiliated companies as well as their family members are not entitled to participate in the competition. In addition, the organizer reserves the right to exclude persons from participation at its own discretion if there are justified reasons, for example
a) in the event of manipulation in connection with the conduct of the competition,
(b) in the event of infringement of these Conditions of Participation,
c) false or misleading information in connection with participation in the competition.
Participation
The participation in the competition takes place by sending the participation photo by email to info@mate-tee.de or Facebook message.
By sending the photo, the participant accepts these terms and conditions. The closing date for entries to the competition is 31.12.2019 23:59.
Participation is only possible until the closing date. Photos received after the deadline will not be considered for the draw. The electronically recorded receipt of the entry photo by the organizer serves to verify that the entries have been received by the deadline.
Only one submitted registration per participant will take part in the competition. It is prohibited to use several e-mail addresses or several Facebook profiles to increase the chances of winning.
Termination of the competition
The organizer expressly reserves the right to interrupt or terminate the competition at any time without prior notice and without giving reasons and to adapt these conditions of participation.
Winnings, Notification and Transmission of Winnings
The following prizes will be awarded:
- 1 Mate Mateo Vetro (orange) + voucher with 10% discount*.
- 3 Mate Mateo Flor (1 cyan, 1 yellow and 1 red) + 10% discount voucher*.
*The voucher can be redeemed in the webshop www.mate-tee.de .
From all submissions the 4 most beautiful photos are selected. The winners will be determined by Delicatino GmbH.
The winner(s) of the raffle will be notified by the organizer within 2 weeks after the closing date for entries by e-mail or private message on Facebook. In case of an undeliverable notification, the organizer is not obliged to investigate further and can determine a new winner. If the winner does not respond within one week of being notified of a win, the Promoter shall also be entitled to determine a new winner.
The prize will be handed over exclusively to the winner.
It is not possible to exchange, collect or pay the prize in cash. Material prizes will be sent to the winner by post to his home address, the organizer will bear the shipping costs. The prize can only be delivered to a residential address within Europe. The winner himself is responsible for any taxation of the prize.
Transfer of rights to the entries
All rights to the submitted photographs are transferred to Delicatino GmbH. With the submission the participant agrees that the photographs may be used as advertising film/advertising photos in changed or unchanged form and without spatial, temporal and content-related restrictions for an advertising external representation. This includes in particular the reproduction and distribution of the recordings via the Internet (e.g. Facebook/Instagram/Website).
The participant acknowledges and confirms that there are no further claims for additional remuneration or invoicing and that no further claims are made to Delicatino GmbH in this connection.
Data protection
In order to participate in the competition it is necessary to provide personal data. The participant affirms that the personal details provided by him/her, in particular first name, surname and e-mail address, are true and correct. In the case of non-cash prizes, further personal data, such as the address, will be requested from the winners at the end of the competition as part of the prize notification. The collection and processing of personal data serves exclusively for the execution of the competition and, if necessary, for sending the prizes.
The personal data of the participants will neither be passed on to third parties nor made available to them for use without their consent. An exception is the company commissioned to carry out the competition, in particular the dispatch of the prize (dispatch service provider), which collects, stores and uses the data for the purpose of carrying out the competition.
The participant may at any time obtain information about his data stored by the organizer, object to the use of his data and demand their deletion. For this purpose, a simple letter to Delicatino GmbH, Neidenburger Straße 9, 28207 Bremen or an e-mail to info@mate-tee.de is sufficient. After revocation of the consent the collected and stored personal data of the participant will be deleted immediately.

Facebook Disclaimer
The competition has no connection with Facebook and is in no way sponsored, supported or organized by Facebook. The sole contact person and responsible party is the organizer.
Liability
The Organiser shall not be liable for any damage caused by errors, delays or interruptions in transmission, faults in the technical equipment and services, incorrect content, loss or deletion of data, viruses or in any other way during participation in the competition, unless such damage was caused intentionally or through gross negligence by the Organiser (its organs, employees or vicarious agents). The foregoing limitation of liability does not apply in the case of injury to life, limb or health or in the case of fraudulently concealed defects.
Applicable law
The competition is subject exclusively to the laws of the Federal Republic of Germany. The legal process is excluded.
Severability clause
Should any provision of these conditions of participation be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by the legally permissible provision which comes as close as possible to the economic meaning and purpose expressed in the invalid provision. The same shall apply mutatis mutandis in the event of a loophole in these Conditions of Participation.
